DS Biopharma Announces Notification of Patent Allowance for U.S. Application 13/318,290, Protecting its Lead Candidate and Next Generation Compounds
Exclusivity for Topical Compositions of DS Biopharma‘ Lead Compound as well as the Early Stage Follow-on Compounds

DS Biopharma, a privately held biopharmaceutical company, announced today that the United States Patent and Trademark Office (USPTO) has issued a Notice of Allowance for U.S. patent application serial number 13/318,290, entitled “Use of PUFAs for Treating Skin Inflammation.” The application has allowed claims that provide DS Biopharma exclusivity for topical compositions of its lead compound DS107 as well as the early stage follow-on compound DS109. In addition, the allowed claims provide exclusivity for methods of using these compositions.
DS Biopharma believes the allowance of this patent confirms the novelty of its approach to treating skin ailments. With many of its important patents coming into fruition, the company looks forward to justifying its development strategy with data from the ongoing research programs.
A Notice of Allowance is issued after the USPTO makes a determination that a patent can be granted from an application. The granted patent will provide DS107E, DS109A and other DS Biopharma‘ compositions, exclusivity into 2030.
DS107E is a topical formulation of a semi-synthetic derivative of dihomo-gamma linolenic acid, a fatty acid. DS107E is currently being developed as an advanced therapy for treating skin diseases.
